digital desk- The Supreme Court has rejected the PIL seeking to stop the caste-based census. During the hearing held on Friday, the court not only rejected the petition but also expressed strong displeasure over the language used in it. During the hearing, Chief Justice Surya Kant was clearly seen expressing dissatisfaction towards the petitioner. The Chief Justice put sharp questions to the petitioner, saying that “indecent language” has been used in the petition, which is against the dignity of the court. He asked who created such language and why it was used. The court made it clear that such language is not acceptable and the petitioners should present their views in a dignified and constitutional manner.


Justice Joymalya Bagchi and Justice Vipul M Pancholi heard the matter.


The case was heard by a bench headed by the CJI and also comprising Justice Joymalya Bagchi and Justice Vipul M Pancholi. Dismissing the petition unanimously, the bench said that such issues should be approached by the concerned administrative authorities before coming to the court. In the petition, a demand was made to direct the Central Government to stop the caste based census. Additionally, it also included a request to formulate a policy to provide economic incentives to single-child families. However, the court did not consider these demands worthy of consideration and rejected the petition.


Advice given to the petitioner


During the hearing, CJI Surya Kant also said that before bringing any issue to the court, the concerned departments and officials should be informed. He said that “If there is no solution at the level of officials, then only the court should be approached.” He advised the petitioner that as a conscious citizen and a person with understanding of law, he should first try at the administrative level. It is noteworthy that even before this, on February 2, the Supreme Court had refused to consider another PIL, in which questions were raised on the process of collection and verification of caste-based data in the 2027 census.
