Jabalpur: A petition was filed in the High Court against non-payment of retirement dues and pension. During the hearing, a single bench of High Court Justice MS Bhatti found that the said petition was filed in the year 2010. In the previous order, instructions were given to submit information regarding withdrawal of money from GPF and other deductions, which was not followed.


The single bench, while giving one week’s time to present the information, has imposed a cost of Rs 10,000 on the District Education Officer present in the court. The cost amount will have to be deposited personally to the District Education Officer.


The petition was filed in 2010


A petition was filed in 2010 on behalf of Prakash Narayan Shukla, retired from the education department. It was said in the petition that the dues were not paid after retirement. His pension was also not started. Due to which his family is facing the problem of financial crisis. The petitioner is a disabled person and is not entitled to any mercy or favor but to a legitimate right earned through years of service.


High Court had issued orders to submit the affidavit


It was said in the petition that his GPF amount of Rs 65 thousand, arrears of 6th pay scale Rs 1 lakh 7 thousand, leave encashment amount of Rs 1 lakh 70 thousand and gratuity amount of Rs 3 lakh 58 thousand have not been paid. During the last hearing, the High Court, after taking instructions from the District Education Officer, had issued orders to submit an affidavit regarding the action taken after the correspondence after February 2011. Apart from this, complete details of GPF deduction were collected and its information was sent to the Joint Director of Public Instruction Department.


‘If the information is not presented in the next hearing then the Chief Secretary should be present’


During the hearing on the petition on Tuesday, Jabalpur District Education Officer Ghanshyam Soni personally appeared in the court. He told that complete information has not been collected. He requested the single bench to provide one week’s time. While issuing the order after the hearing, the single bench has given one week’s time. Also, a cost of Rs 10,000 has been imposed for not presenting the previous information.




The single bench has said in its order that if the information is not presented during the next hearing, then the Principal Secretary will personally appear and give information regarding the mistake. The next hearing on the petition has been scheduled after a week. Advocate Dinesh Upadhyay appeared on behalf of the petitioner.
