Questions raised on the tune of the song


Tu Meri Main Tera, Mumbai: Karan Johar’s much awaited film ‘Tu Meri Main Tera’ is going to hit the theaters soon. Recently its trailer was released, which was greatly appreciated by the audience. However, the film is facing legal controversy even before its release, due to the song ‘Saat Samundar Paar’.




Initiation of legal action


Trimurti Films Private Limited has filed a petition in the Bombay High Court against Karan Johar’s Dharma Productions. It has been alleged that the copyright of the 1992 song ‘Saat Samandar Paar’ has been infringed in the film. The production house has demanded damages of Rs 10 crore and has also appealed to ban any kind of use of the song.

Dharma Productions, Namah Pictures Private Limited, music label Saregama India Limited and rapper-composer Badshah have been made accused in this case. The case has been placed before single-judge Justice Sharmila Deshmukh, and will be heard on December 22.

The petition states that Trimurti Films is the first owner of the copyright of Vishwatma and its songs. According to this, Trimurti owns the rights to all musical and literary works as well as sound recordings.





contract dispute


The complaint also states that a 1990 contract with Saregama’s former company, The Gramophone Company of India Limited, gave rights for the reproduction and distribution of existing audio works. Trimurti states that this contract did not include the right to modify or adapt the recording of the song.
