Bombay High Court said that the police is showing laxity in investigating the complaints and ignoring the law. In Kundan Patil’s petition, the court sought response from the Center on the negligence of Kashimira Police and fixed the next hearing of the case for December 19.


The Bombay High Court has strongly commented on the slow process and disregard for law in investigating police complaints. The court said that the police is completely ignoring the sections of the law and is working slowly in investigating the complaints. Not only this, the court has also sought response from the Central Government in the matter.


Let us tell you that the High Court made this comment on the petition of Kundan Patil, in which he had sought direction to register an FIR on his complaint at Kashimira Police Station, Mira Road, Mumbai. Police told the court that the investigation into his complaint is still going on.


Police said- investigation is still going on
During the hearing, the police also told the court that a complaint was also registered against them in August, the investigation of which is also going on. The court noted that as per Section 173(3)(i) of the Indian Civil Defense Code (BNSS), the police are required to complete the preliminary investigation within 14 days to decide whether further action is required. But the police often take time for months in the name of ‘preliminary investigation’. The court described this as ‘complete ignorance’ towards the law.


Is the police deliberately not following the law?
Along with this, the High Court also emphasized that either the police is not aware about BNSS, which came into effect in July 2024, or they are deliberately not following the law. The court sought clarity from the Home Department whether BNSS was applicable to all police stations and if yes, why it was not followed. The court posted the next hearing of the case for December 19 and directed the Additional Solicitor General to appear on behalf of the central government.
