New Delhi. Delhi Police has sought time to register sanction under section 195 of CrPC against Sakariya Rajeshbhai Khimji and Syed Tahseen Raza, who attacked Delhi CM. An FIR was lodged at the Civil Lines police station following the alleged attack on CM Rekha Gupta during a public hearing at her official residence in August. Additional Sessions Judge (ASJ) Ekta Gauba Mann asked the Special Public Prosecutor (SPP) as to how cognizance was taken if the sanction was not filed.

SPP Pradeep Rana submitted that the approval is pending in the Home Department. A complaint was sent long ago through DCP. It was also submitted that there is a judgment of the Supreme Court, which says that sanction can be filed even after the charge sheet has been filed. A supplementary charge sheet with sanction will be filed within two weeks. After hearing the arguments of the Delhi Police counsel, the matter was fixed for December 15 for arguments on the charge. The court directed the investigating officer to ensure that the sanction is filed within time. On November 10, Delhi’s Tis Hazari Court had listed the case to hear arguments on framing of charges. Delhi Police has already filed a charge sheet against two accused and cognizance of the same has been taken. Apart from this, the police had also included sections of attempt to murder, criminal conspiracy etc. in the FIR.
